These General Conditions have as their object the purchase of products and services, carried out remotely via the Internet on the site www.tuningbikestore.com , belonging to the company TuningBike srls PI 17481511008.
- Acceptance of the general conditions of sale.
- The contract stipulated between TuningBike and the Customer must be considered concluded with the acceptance, even partial, of the order by TuningBike , according to the methods described in points 2.2, 3.1, 3.2. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions transcribed below.
- The Customer is excluded from any right to compensation for damages or indemnity, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the failure to accept or fulfill, even partially, an order.
- How to purchase.
- The Customer can only order the products present in the TuningBike electronic catalogue at the time of placing the order and viewable online at the address (URL) http://www.tuningbikestore.com , as described in the relevant information sheets. It is understood that the image accompanying the description sheet of a product may not be perfectly representative of its characteristics but may differ in colour, size, accessory products present in the figure.
- Correct receipt of the order is confirmed by TuningBike by means of an e-mail response, sent to the e-mail address provided by the Customer. The response is automatically generated by the system and cannot be considered acceptance of the order in itself, but only confirmation of receipt of the order.
- This confirmation message will report the Date and Time of execution of the order and a 'Customer Order Number', to be used in any further communication with TuningBike . The message contains all the data entered by the Customer, who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.
- The wording "available" in the product status should not be understood as a product ready for delivery, but as material available either in our warehouses, or in those of our suppliers, with delivery up to 10 working days.
- Status of the Order.
- Order status can only be viewed by registered customers.
- Total or partial non-acceptance of the order will be reported on the page, and through a communication or through the reduction or cancellation of the quantities of the products.
- Payment methods.
- Cash on delivery: payment in cash (banknotes) upon delivery. Maximum amount € 1000 VAT included. Available only for deliveries in Italy. Payment on delivery has an additional cost.
- Advance bank transfer: to be sent only after our order confirmation email.
- Other payments: agreed between TuningBike and the Customer.
- Delivery methods.
- TuningBike accepts orders for delivery worldwide using express couriers selected based on the destination (except for exceptions due to courier impossibility).
- For each order placed, TuningBike issues a transport document or invoice accompanying the material shipped.
- Delivery costs are the responsibility of the Customer and are calculated when the order is placed, and subsequently confirmed by email . The payment for the goods by the Customer will be made using the method chosen when ordering. Nothing more is due by the Customer than the total of the order unless otherwise agreed and confirmed by the Customer (e.g.: adding products to the order, special shipments).
- TuningBike cannot be held responsible for any delays in processing the order or in delivering the items ordered.
- Unless otherwise specified by our Customer Service, delivery is intended to be at street level. Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to that indicated in the accompanying document
- that the identity and quality of the products, possibly indicated on the packaging, correspond to those purchased
Any discrepancy in the number of packages or irregularities, as well as any loss or damage, must be immediately reported to the carrier. If the goods are collected, they must be collected "with reservation". Once the courier's document has been signed, the Customer cannot raise any objection regarding the external characteristics of the goods delivered.
- Any defective products or those that show breakages upon receipt of the goods may be returned only after authorization from us. The customer will take care to report such defect by email within and no later than 3 (three) working days from receipt of the material. If the shipment is made with a courier chosen by the customer, TuningBike assumes no responsibility for any damage or defects attributable to poor handling of the transport.
- Cancellation, Withdrawal and Refunds.
- The customer may cancel the order until it has been shipped. Alternatively, after paying and receiving the order, the customer may withdraw from the purchase in accordance with the procedures established by law.
- The right of withdrawal applies to all unused , undamaged and original packaged products. It does not apply in the case of supply of goods packaged to measure or clearly personalized or which, by their nature, cannot be returned or are liable to deteriorate or alter rapidly.
- For all returned products, a 10% re -stocking fee will be applied to the value of the product at the time of purchase.
- The intention to withdraw, according to the law, must be communicated by registered mail within 10 days of purchase. Wanting to offer a faster service, TuningBike accepts withdrawal communications also sent by email. Before shipping, we ask you to contact us anyway to obtain an RMA number (authorized return of goods), necessary for the return. It is necessary to send the products to be returned in their original packaging, writing the RMA number on the package. It is also necessary to attach a return transport document with the reason "RETURN OF GOODS", and the reference to the transport document or purchase invoice.
- Return shipments without a transport document or RMA number on the package will not be accepted by the TuningBike Warehouse . Shipments with freight collect or with costs paid by TuningBike will also not be accepted . All direct costs of returning the goods to the sender are the responsibility of the consumer. If the consumer requests that Racing Bike take care of the return shipment, TuningBike has the right to accept or refuse this task. If TuningBike accepts this task, it cannot be held responsible for the risks arising from the shipment (except in the case in which the consumer requests optional paid insurance coverage). The cost of the return shipment, even if it is managed by TuningBike , is the responsibility of the consumer, and is approximately double the cost of the original shipment. For an exact quotation, we invite you to request a written quote.
- TuningBike , upon correct execution of the entire procedure reported, will proceed as soon as possible (maximum 30 working days from receipt of the goods) to credit the Customer with the amount paid on the invoice, excluding shipping costs (art. 5, paragraph 6, Legislative Decree no. 185 of 22/05/1999). In the case of shipments returning from foreign countries not belonging to the EU, any customs duties due for the return will be considered to be borne by the consumer. Refunds for orders will be made only by bank transfer.
- Warranty.
- All products sold by TuningBike are covered by the manufacturer's conventional warranty and by the 24-month warranty for defects of conformity, pursuant to Legislative Decree 24/02. To benefit from warranty assistance, the Customer must keep the purchase invoice.
- The manufacturer's conventional warranty is provided according to the methods illustrated on the site or in the documentation included in the product packaging. If, following intervention by an Authorized Service Center, the Manufacturer or TuningBike, the defect is found not to be covered by the manufacturer's conventional warranty, the Customer will be charged for any costs of verification and repair, as well as transport costs, if incurred by TuningBike .
- The 24-month warranty pursuant to Legislative Decree 24/02 applies to products that have a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty is reserved for the private Consumer (a natural person who purchases the goods for purposes not related to their professional activity, or makes the purchase without indicating a VAT number in the order form). In the event of a lack of conformity, TuningBike will , at no cost to the Customer, restore the product's conformity by repairing/replacing it or reducing the price, up to the termination of the contract. If, following intervention by an Authorized Service Center, the Manufacturer or TuningBike , the defect does not result in a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and restoration, as well as transport costs if incurred by TuningBike .
- Replacements in case of DOA (Dead On Arrival : product not working upon delivery) occur only if expressly provided by the manufacturer. The times of replacement or possible repair of the product depend exclusively on the policies of the manufacturer.
- In the event that, for any reason, TuningBike is unable to return to its customer a product under warranty (repaired or replaced), TuningBike may proceed at its own discretion to refund the entire amount paid or to replace it with a product of equal or superior characteristics.
- No damages can be requested from TuningBike for any delays in carrying out repairs or replacements.
- TuningBike by telephone or email . An operator will provide all the necessary information. At the time of contact, you must have the purchase receipt (invoice, warranty certificate) issued by TuningBike . TuningBike reserves the right not to provide a guarantee for the product or motorcycle in the absence of the relevant purchase receipt or warranty certificate. The operator will provide an RMA number (Return of Goods Authorized) to be placed on the outside of the package used for the return. Shipments without the RMA number on the package will not be accepted by the TuningBike Warehouse . The product must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc. ). To limit damage to the original packaging, we recommend placing it in a second box or in the packaging used for the outward shipment. In all cases, the application of labels or adhesive tape directly on the original product packaging should be avoided.
- Any intervention carried out by personnel not authorised by TuningBike will immediately void the warranty.
- A warranty intervention leaves the duration of the product warranty period completely unchanged.
- The warranty will not be valid in cases where the product failure is caused by improper use, incorrect installation, assistance interventions, tampering or modification of the product, maintenance or repairs carried out by technicians not authorised by TuningBike .
- All products distributed by TuningBike are designed and compliant with the original parts of the motorcycles; TuningBike does not assume responsibility for incorrect functioning with other aftermarket products.
- Approval
- With the exception of the products defined in the description with the terms "approved" and/or "street legal ", the products sold by TuningBike are not approved for use on public roads. They are intended solely for use in sporting events on the track or in closed circuits as well as fairs or exhibitions. Approval is intended to be limited to countries belonging to the European Union.
- Limitations of liability - Disclaimer
- INFORMATION ON THIS SITE: We try to keep this site updated as much as possible. However, due to the very nature of the products and the continuous commitment of the manufacturers to achieve increasingly higher quality standards, we cannot guarantee that the information and images are those that truly and best describe the products. Although prices, descriptions, images, applications and in any case all the information on this site are correct, they may contain errors, inaccuracies, publication errors, be updated and updateable at any time without TuningBike being held responsible for this.
- TuningBike cannot be held responsible towards any person for any particular, indirect or consequential damages, delays, lost profits connected with this material. The applications of each product are suggested by the individual manufacturers, we do not guarantee correspondence with the original spare parts. Driving a motorbike can be a source of danger for yourself and for others, Racing Bike can never be held responsible for direct or indirect damages, accidents, injuries, wounds, deaths or anything else that occurs using the products marketed on this site. Using products not intended for road use can be considered a crime, punishable by fine, arrest or in any case prosecutable by the laws of the state in which it is used; TuningBike disapproves of the use of products not intended for road use outside of sporting events, tracks, closed circuits as well as fairs or exhibitions.
- The sales contract between the Customer and TuningBike is deemed to be concluded in Italy and regulated by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of his/her municipality of residence; in all other cases the territorial jurisdiction is exclusively that of the Court of Velletri – Rome (Italy ).
